## DSGVO und Datenschutz
**Gesamteinschätzung:** Conditional

For companies with GDPR requirements, Gemini in Google Workspace or Gemini via Google Cloud / Vertex AI is significantly more suitable than the private Gemini app. The strongest assessment applies when a Workspace/Cloud contract with a DPA, EU data region, admin controls, disabled risky add-on services, DLP, and a clear policy for personal data is used. The private Gemini app is only recommended to a limited extent for sensitive personal data, confidential company data, or regulated content.

**Conclusion:**

For GDPR-sensitive organizations, Gemini via Google Workspace or Google Cloud / Vertex AI is the most robust option, because [DPA,](https://cloud.google.com/terms/data-processing-addendum) [no-training commitments](https://knowledge.workspace.google.com/admin/gemini/generative-ai-in-google-workspace-privacy-hub?hl=de), admin controls, and in some cases EU data residency or regional processing are available there. The private Gemini app should not be used for confidential or sensitive personal data unless the content has been deliberately approved for disclosure and the data protection implications have been reviewed.

With Gemini, a clear distinction must be made between the private Gemini app, Gemini in Google Workspace, the Gemini API / AI Studio, and Gemini via Google Cloud / Vertex AI.

**Private Gemini app:** For regular user accounts, Google processes prompts, uploaded content, files, images, live interactions, location data, and usage data. If “Gemini Apps Activity / Keep Activity” is enabled, content may be used to improve Google services and AI models and may in some cases be reviewed by human reviewers; Google explicitly warns against entering confidential information. If activity is disabled, future chats are, according to Google, not used for training, but are still stored for up to 72 hours; data already reviewed by human reviewers may remain stored for up to three years.

**Gemini in Google Workspace:** significantly better suited for GDPR-relevant business use. Google states that prompts and Workspace content are customer data, are not used to train generative AI models without permission, are not shared outside the organization without permission, and are not reviewed by humans without permission. Use is subject to the Cloud Data Processing Addendum / DPA. Gemini API / AI Studio: For unpaid services, Google generally uses content to improve products and ML technologies; however, for users in the EEA, Switzerland, and the UK, the Gemini API Terms state that the data rules for Paid Services apply. For Paid Services, prompts and responses are not used for product improvement and are processed in accordance with the Data Processing Addendum; Google logs prompts and responses for a limited time for abuse and security monitoring.

**Positive:** DPA for Workspace, Google Cloud, and Paid API contexts; SCCs for international transfers; no-training commitments for Workspace, Gemini for Google Cloud, and Paid/API contexts; certifications and admin controls in Workspace.

**Negative / points to review: **US/global provider, subprocessors and processing outside the EU are possible, the private Gemini app is not recommended for confidential or sensitive personal data, and with the Gemini API certain security/abuse logs may be stored transiently or cached in countries where Google or its contractors operate facilities.
