GDPR-compliant usage possible?
GDPR assessment: From a GDPR perspective, Descript is suitable with limitations.
Positive is that Descript mentions SOC 2 Type II, documents references to GDPR/CCPA/Privacy by Design, protects data at rest with AES-256 and in transit with HTTPS/TLS, and, according to its Enterprise help documentation, treats project information confidentially. For AI processes, Descript states that third-party providers such as OpenAI are contractually prohibited from using data to train their models; Descript’s own use of data for AI training is opt-in or can be disabled.
Negative is that, according to its Terms, Descript may process, transfer, and store information in the USA and other countries. In addition, the subprocessors list shows many US data regions, and media content, voices, transcripts, and project metadata are particularly sensitive types of data.
Server location: No EU-only hosting guaranteed; Descript states processing/storage in the USA and other countries, with subprocessors predominantly linked to the US.
