GDPR-compliant use possible?
Positive: xAI has a Europe Privacy Addendum, designates X.AI LLC as the controller for Europe, offers data protection rights, a Privacy Portal, opt-out for model training, Private Chat, a Business DPA, SCCs, and a subprocessors list. For Business/API, xAI states that it does not use business data for model training; according to the Enterprise FAQ, inputs/outputs are automatically deleted unless an exception applies.
Negative: According to the Europe Addendum, xAI processes all personal data in the USA, where its primary data centers are operated. Consumer content may be used for training unless disabled. Grok on X is subject to X’s terms. In addition, DPC investigations are underway into X/Grok training with EU/EEA data and into sexualized AI content.
Server location: according to xAI’s Europe Addendum: USA; the subprocessors list shows predominantly US locations, and one xAI subsidiary in the UK. AVV/DPA: available for Enterprise/API; not usable as a classic data processing agreement for pure consumer use. SCCs: provided for international transfers in the DPA.
