GDPR-compliant use possible?
GDPR assessment: Mistral AI is well suited from a GDPR perspective, especially for European companies and professional use.
Positive is that Mistral AI documents privacy controls for Le Chat and the API: Le Chat Free may use conversations for model improvement, but users can choose to opt out; Le Chat Pro, Team, and Enterprise do not use conversations for model training by default; API data is not used for model training; Connector data and Libraries are not used for training. Also positive are the DPA, GDPR rights, SCCs for international transfers, subprocessor arrangements, and technical/organizational safeguards.
Negative is that, depending on the feature, data may be temporarily transferred outside the EU to subprocessors, and that Free/certain Le Chat uses are weaker from a privacy perspective than Pro/Team/Enterprise or the API.
Server location: By default, Mistral hosts data in the European Union; when the US API endpoint is explicitly used, data is hosted in the USA
