Overall Assessment:
A positive aspect is that ELEK has published a globally applicable privacy policy that explicitly addresses the GDPR, Australian Privacy Principles, and other international regulations. The company designates a data protection contact, a DPO, and an EU contact person. Third-party providers are required to enter into Data Processing Agreements.
For ELEK AI, the provider explicitly states that third-party AI services are not permitted to use project data for model training. Project inputs and calculation results must remain within the controlled ELEK software environment.
A negative aspect is that ELEK Software is based in Sydney, Australia, and uses third-party providers outside of Australia and the EEA. According to the Security Policy, the primary cloud location is at AWS in Sydney. No EU data residency is specified.
