GDPR-compliant use possible?
With Gemini, a clear distinction must be made between the private Gemini app, Gemini in Google Workspace, the Gemini API / AI Studio, and Gemini via Google Cloud / Vertex AI.
Private Gemini app: For regular user accounts, Google processes prompts, uploaded content, files, images, live interactions, location data, and usage data. If “Gemini Apps Activity / Keep Activity” is enabled, content may be used to improve Google services and AI models and may in some cases be reviewed by human reviewers; Google explicitly warns against entering confidential information. If activity is disabled, future chats are, according to Google, not used for training, but are still stored for up to 72 hours; data already reviewed by human reviewers may remain stored for up to three years.
Gemini in Google Workspace: significantly better suited for GDPR-relevant business use. Google states that prompts and Workspace content are customer data, are not used to train generative AI models without permission, are not shared outside the organization without permission, and are not reviewed by humans without permission. Use is subject to the Cloud Data Processing Addendum / DPA. Gemini API / AI Studio: For unpaid services, Google generally uses content to improve products and ML technologies; however, for users in the EEA, Switzerland, and the UK, the Gemini API Terms state that the data rules for Paid Services apply.
